Legal Advice – Donor information access

Many states in Australia now have a central donor conception register.  Queensland introduced its register in late 2024 with the introduction of the Assisted Reproductive Technology Act (ART) 2024 (Qld).

Donor conception registers play an important role in ensuring that donor-conceived individuals and others involved in donor conception have access to relevant and accurate information.

In Queensland, ART service providers are required to supply both current and historical records to the newly established register, provided the records are still available. This offers the potential for donor-conceived individuals born prior to the commencement of the register to access relevant information—subject to the availability of records and any required consents.

However, it’s important to note that access to historical information is not guaranteed. If an ART provider or medical practitioner has not retained records from earlier donor conception procedures, that information may not be accessible. Where such records do exist, the provider is legally obligated to submit them to the registrar for inclusion in the register.
